Do You Legally Need an EPC to Sell or Rent Your Property?

Selling or renting a property in the UK? Here's what the law says about EPCs, how long they last, and what happens if you don't have one.

If you're selling or letting a property in the UK, the short answer is yes. You're legally required to have a valid Energy Performance Certificate (EPC) before you market it.

What an EPC actually is

An EPC rates how energy efficient a property is, from A (most efficient) to G (least efficient). It also gives an idea of typical running costs and lists simple improvements that could raise the rating. It's a legal document, registered on the government's official database, not just a piece of paper for your own records.

When you need one

  • Selling a property, an EPC has to be commissioned before the property is marketed, and made available to anyone viewing it.
  • Renting out a property, you need a valid EPC before a tenancy starts, and the property currently needs to meet a minimum rating (E or above) to be legally let.
  • New builds, also require an EPC once complete.

How long it lasts

An EPC is valid for 10 years. If yours has expired, or you've never had one for the property, you'll need a new one before you can sell or let.

What happens if you don't have one

Selling or letting without a valid EPC can result in a fine from Trading Standards, and it can also hold up a sale or letting. Solicitors and letting agents will usually ask for it early on, so it's best sorted before you need it rather than once you're mid-sale.
